Calories Check provides AI-generated estimates only. The app is not a medical device and does not provide medical, dietary, or professional nutrition advice.
1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the Calories Check mobile application and related services ("App", "Service", "we", "us", or "our"). By downloading, accessing, or using the App, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the App.
2. Apple App Store Terms
If you downloaded the App from the Apple App Store, your use of the App is also subject to Apple's applicable terms, including the Apple Licensed Application End User License Agreement and the Apple Media Services Terms and Conditions.
If these Terms conflict with Apple's mandatory App Store terms, Apple's terms will apply to the extent required.
3. What the App Does
Calories Check lets you take or select a food photo, upload it for AI analysis, and receive estimated food names, calorie ranges, macronutrient ranges, health score, confidence level, summaries, and suggestions. The App may also store meal history locally on your device.
4. AI Estimates and No Medical Advice
All nutrition information generated by the App is approximate and may be incomplete, inaccurate, or unsuitable for your circumstances. AI may misidentify food, portions, ingredients, preparation methods, sauces, hidden oils, allergens, or nutrition values.
Do not use Calories Check as a substitute for professional medical, nutrition, dietary, fitness, or health advice. Always consult a qualified professional before making health, nutrition, weight-loss, medical, or dietary decisions, especially if you have a medical condition, food allergy, eating disorder, pregnancy, or special dietary needs.
5. Free Plan and Paid Subscriptions
Calories Check may offer a limited free plan and paid subscription plans. Current scan limits may include:
- Free: 5 lifetime scans.
- Premium: 500 scans per Apple billing cycle.
- Pro: 1,500 scans per Apple billing cycle.
Scan limits, plan names, pricing, features, and availability may change over time. Any updated pricing or plan details shown in the App Store or in the App at the time of purchase will apply to your purchase.
6. Subscription Billing, Renewal, and Cancellation
Subscriptions are processed by Apple through your Apple ID. Payment will be charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless cancelled according to Apple's subscription rules before the end of the current billing period.
You can manage or cancel your subscription in your Apple ID subscription settings. If you cancel a subscription, you may continue to access paid features until the end of the current paid billing period, unless Apple or applicable law provides otherwise.
Refunds, billing issues, and payment disputes for App Store purchases are handled by Apple according to Apple's policies. We do not control Apple's refund decisions.
7. Quota and Fair Use
Scan quota is tracked on our backend to prevent abuse and enforce plan limits. Paid quota resets according to the Apple billing cycle associated with your active subscription. Free scan quota is lifetime-based and does not reset when you reinstall the App.
We may limit, block, or suspend access if we detect abuse, automated requests, fraudulent purchases, attempts to bypass quota, reverse engineering, attacks on the API, or other behavior that harms the Service.
8. User Content
You are responsible for photos and other content you submit to the App. You represent that you have the right to submit such content and that your use of the App will not violate any law or third-party rights.
You grant us a limited, non-exclusive right to process submitted content solely as necessary to provide, secure, maintain, and improve the Service, including sending food photos to AI service providers for analysis.
9. Acceptable Use
You agree not to:
- Use the App for unlawful, harmful, fraudulent, or abusive purposes.
- Upload content that is illegal, harmful, abusive, or violates another person's rights.
- Attempt to bypass subscription, quota, authentication, App Check, or security controls.
- Reverse engineer, scrape, overload, attack, or interfere with the App, API, or backend.
- Use the App to develop competing datasets or services in violation of these Terms.
- Misrepresent AI estimates as medical, clinical, or professional advice.
10. Privacy
Our Privacy Policy explains how we collect, use, store, and share information. By using the App, you acknowledge our Privacy Policy.
11. Availability and Changes
We may modify, suspend, or discontinue any part of the App at any time. Features may not always be available, may vary by region, and may depend on Apple, Firebase, OpenAI, hosting providers, internet connectivity, and other third-party services.
12. Intellectual Property
The App, design, software, trademarks, logos, and related materials are owned by us or our licensors and are protected by intellectual property laws. You may use the App only as permitted by these Terms and applicable App Store terms.
13. Disclaimer of Warranties
To the maximum extent permitted by law, the App and Service are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not warrant that the App will be accurate, reliable, uninterrupted, secure, error-free, or suitable for your needs.
14. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, health outcomes, or business opportunities arising from or related to your use of the App.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
15. Termination
We may suspend or terminate your access to the App if you violate these Terms, misuse the Service, create risk for us or others, or if required by law or platform rules. You may stop using the App at any time.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date and may provide notice in the App or by other reasonable means. Continued use of the App after changes means you accept the updated Terms.
